Description
Signed into law on December 9, 2010, the Telework Enhancement Act of 2010 law specifies the roles, responsibilities, and expectations for all Federal executive agencies with regard to telework policies; employee eligibility and participation; program implementation; and reporting. See 5 U.S.C. Ch. 65. Fundamental to the Telework Enhancement Act of 2010 is that: (1) telework is not an employee right; and (2) employee participation in telework is voluntary. However, the impact of the COVID-19 pandemic has substantially increased agencies use of telework, blurred the lines of voluntary participation, and expanded the role of telework as a reasonable accommodation. As agencies begin to resume more in-person and public-facing operations, there is bound to be confusion and disputes over continued telework eligibility, participation, and as a means of effective reasonable accommodation.

conduct, and leave; and
-Recognize when and how to request telework as an effective reasonable accommodation.
